I made an editorial statement based on the statement made by Vice Mayor Teresa Real Sebastian at the end of the October 5th meeting.  Vice Mayor Teresa Real Sebastian advised me that she removed Margaret Leung from the Planning Commission for a “Brown Act” violation.  She did not explain how the “Brown Act” was violated. “

I stated, “Our city attorneys determined that Margaret Leung violated the “Brown Act” without all of the facts”.

I have since learned that this was not a true statement as Vice Mayor Teresa Real Sebastian removed Margaret Leung from the Planning Commission based on “Municipal Code: 2.82.070 Removal by city council”:

“Notwithstanding any other provision of this chapter, all members serve at the pleasure of the appointing city council member and may be removed by that council member at any time. (Ord. 2098 § 2, 2013)”

“Margaret Leung has stated that based on MPK Municipal Code that all

Commissions are volunteers that work at the pleasure of the City

Council and Vice Mayor’s statement is in contradiction to the letter she received from the City Manager.”
